Edge Checkout Terms
The agreement for saving your details and buying at participating stores by replying to a text.
These terms are an agreement between you and the company that provides Edge Checkout for your shipping country ("Edge Checkout", "we", "us"):
- if your shipping address is in the European Economic Area (EEA), the United Kingdom, Switzerland, Gibraltar, Guernsey, Jersey or the Isle of Man: Zobi OÜ, a private limited company registered in Estonia under registry code 17551980, Maakri 23a, 10145 Tallinn, Estonia;
- everywhere else: Valinor Partners Inc., a Delaware corporation, 1007 N Orange Street, 4th Floor #5604, Wilmington, DE 19801, United States.
Contact: support@edgecheckout.com.
If you ship to the United States, section 14 means disputes with us are decided by an arbitrator, one person at a time, not by a judge or jury and not as a class action, unless you opt out within 30 days.
1. What Edge Checkout is
Edge Checkout saves your details so you can buy from participating stores by replying to a text message, without typing your card or address again. It is free for you. There is no account or password.
Stores also use our technology to run their own checkout pages, which you may reach from an ad, a website or a text. When you buy on one of those pages you buy from the store (section 6), whether or not you save your details. These terms cover only saving your details with Edge Checkout and buying with them.
2. Joining
You join when you pay by card on a checkout page that shows Edge Checkout and:
- where the page shows a sentence saying that paying means you agree to these terms and to save your details (for example when you ship to the United States), you tap the pay button; or
- where the page shows a box (when you ship to the EEA, the United Kingdom, Switzerland or Canada, for example), you tick the box.
Which one you see depends on the shipping country you enter. Paying with PayPal or Apple Pay does not save anything for Edge Checkout; paying with Google Pay may save your card, as paying by card does.
If the page shows a box and you leave it unticked, you pay once and nothing is saved for Edge Checkout.
Some stores use Edge Checkout only for purchases at their own store; their checkout page says so. Details you save there are used only at that store, not at other stores. If the store where you saved your details stops taking part in the Edge Checkout network, your details can then be used only at that store.
You must be at least 18 and use your own card.
3. What we save
"Your details" means: your card (stored by our card vault provider, never on our own systems: we never see your full card number or security code, and hold only the card brand, last four digits, expiry and a fingerprint that recognises the same card), your name, email address, phone number, billing address and shipping address.
We use your details only to run Edge Checkout. We do not use them for advertising and we do not sell them.
4. How you are recognised
We recognise you by your phone number. Checkout pages do not show your saved details. Before another store can charge your card, the email that store holds for you must match the email you saved.
5. How a purchase works
- A participating store whose texts you receive sends you an offer that states the item and the price.
- You reply YES.
- We let that store charge your card through its payment processor, for that order only. If the store does not already hold your name or shipping address, we may pass it your saved ones for that order.
- The store ships to the address shown in the offer or held by that store for you.
- You get a receipt from the store.
Nothing is charged unless you reply YES to a specific offer.
6. The store is the seller
Each store sells its own products, charges your card through its own payment processor and is responsible for the product, delivery, returns, refunds, cancellations, subscriptions and disputes, under its own terms. Edge Checkout does not sell anything, does not hold your money, is not the merchant of record and is not a party to your purchase. If something is wrong with an order, contact the store.
That includes everything a store offers on a checkout page we run for it:
- Extra items added to your order before you pay.
- Offers after you pay. If you tap to accept one, the store charges the card, wallet or PayPal account you just paid with for that item at the price shown plus any tax, either as a separate order or added to your order, as the offer says. Nothing is charged unless you tap. If the store cannot accept an order you have already paid for, your payment is refunded in full.
- Subscriptions. The checkout page states the price, how often you are charged and how to cancel before you pay. Where the store bills a subscription with our software, we act for the store: the store is the seller, and you can cancel as the checkout page and the store's emails say, including from your subscription page. If a renewal payment fails, the store may try it again, on its own schedule, and may end the subscription if it keeps failing; the store's emails tell you when a payment failed and how to update your card. Replying STOP to a text stops texts; it does not cancel a subscription. Where the law of your country gives you a right to withdraw (in the EU and the UK, within 14 days of receiving your first delivery), use "Withdraw from contract here" on your subscription page or in the store's emails; we stop the subscription, email you an acknowledgement, and the store refunds you as the law requires.
- The store's advertising and analytics tools, which the store may run on its checkout pages under its own privacy policy. They never receive your card details, and when your browser sends a Global Privacy Control signal the page does not load them and nothing is sent to the store's ad platforms.
7. Changing, pausing and deleting
- Change: email support@edgecheckout.com, or pay again on an Edge Checkout page with your new details.
- Stop: reply STOP (or ask in any words to stop texts) to any store's text, email privacy@edgecheckout.com, or unsubscribe from a store's emails with the email tied to your phone; your mobile carrier telling us you opted out counts too. This turns off Edge Checkout for you. Replying STOP also stops texts from every store that uses our messaging service. Stopping is final: Edge Checkout stays off for that phone number, even if a later checkout page offers it.
- Delete: once you stop, no store can charge your saved card, and we delete your saved card, name and billing address 30 days later. We keep your phone number so Edge Checkout stays off for it, and some records for the periods the Privacy Notice sets out. To have them deleted sooner, email privacy@edgecheckout.com and we will delete them promptly, and within one month at the latest, except what we must keep for a payment dispute or by law (see the Privacy Notice).
- Automatic deletion: we also delete a saved card 30 days after it expires (if your bank gives the card a new expiry date, the new date counts), and a card saved without an expiry date 24 months after it was last saved or charged. If you dispute a charge with your bank, Edge Checkout pauses for your phone number until you save a card again at a later purchase: we delete your other saved cards 30 days later, and keep the disputed card blocked until 18 months after the dispute, to prevent fraud, and then delete it.
- Proof that you agreed: when your details are deleted, we keep a short record that you agreed (the wording you saw, the date and time, your IP address, the store and your card's last four digits) for 18 months after your card is deleted, so a store can answer a card dispute, and then delete it.
Stopping or deleting does not cancel a subscription you have with a store; cancel that with the store or from your subscription page. A store may also charge a card or PayPal account you saved on its own checkout page for orders you place with that store and for subscriptions you sign up for there, under its own terms. That permission is the store's, never part of Edge Checkout. While a store subscription still charges the card you saved, we keep that card until the subscription ends, and then delete it.
8. Your responsibilities
Keep your phone number and email current, and tell us if you change your number. Do not let anyone else reply to offers from your phone. If you see a charge you do not recognise, contact the store, your bank and us.
9. Security and fraud
Your card is stored by a card vault provider validated as compliant with PCI DSS at Level 1, the highest level for card storage. We protect the rest of your details with reasonable technical and organisational measures.
To protect you and the stores, we may refuse or hold a payment, a purchase by reply or a save that looks like fraud or card testing, for example after repeated declined payments from the same internet address or email.
10. Changes to these terms
We will tell you by email at least 30 days before a change that affects your rights. A change to section 14 never applies to a dispute you have already told us about. If you do not agree, reply STOP or email privacy@edgecheckout.com before the change takes effect: Edge Checkout turns off for you at once, and your details are deleted as section 7 describes.
11. Ending Edge Checkout
You can leave at any time (section 7). We may stop offering Edge Checkout, or end it for you if it is misused, with notice where possible. When it ends, we delete your details as section 7 describes.
12. Our liability
Edge Checkout is free. We are responsible for running Edge Checkout with reasonable care and for protecting your data. We are not responsible for a store's products, orders, prices, subscriptions or conduct, or for a store's or its payment processor's decision to accept or decline a payment (section 6).
- If your provider is Zobi OÜ: we are liable for damage we cause as the law that applies to you provides. Nothing in these terms limits the rights you have under the consumer or data protection law of the country where you live.
- If your provider is Valinor Partners Inc.: as far as the law where you live allows, Edge Checkout is provided "as is" and "as available", without warranties beyond those in these terms, including any implied warranty of merchantability or fitness for a particular purpose; we are not liable for indirect, incidental, special or consequential damage or lost profits; and the total liability of Valinor Partners Inc. and its affiliates (including Zobi OÜ) to you for all claims about Edge Checkout is limited to USD 100. These limits do not apply to fraud, gross negligence, wilful misconduct, death or personal injury, or anything the law where you live does not let us limit.
13. Law and disputes
If your provider is Zobi OÜ, Estonian law applies; if it is Valinor Partners Inc., the law of Delaware applies. Either way you keep the protection of the mandatory consumer law of the place where you live, and, except as section 14 provides for shoppers in the United States, you may bring a claim in the courts there.
Please contact us first at support@edgecheckout.com. If your provider is Zobi OÜ and we cannot resolve it, you may contact the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) or the consumer body of your country.
14. Arbitration for shoppers in the United States
This section applies if you ship to the United States. Please read it carefully: it affects how disputes are decided.
- Talk to us first. Before starting a claim, send a written notice to support@edgecheckout.com with your name, your phone number, what happened and what you want. We will try to resolve it with you within 60 days.
- Individual arbitration. If we cannot, any dispute between you and Valinor Partners Inc. or its affiliates (including Zobi OÜ) about Edge Checkout or these terms is decided by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, not in court. The Federal Arbitration Act governs this section. The arbitrator decides every question, including whether a dispute must be arbitrated, except what the last point below leaves to a court. A hearing takes place in the county where you live or by video, and fees follow the AAA Consumer Arbitration Rules, under which we pay most of the costs.
- Small claims. Either of us may instead bring an individual claim in small claims court.
- No class actions, no jury. You and we may bring claims only individually, never as a plaintiff or class member in a class, collective or representative proceeding, and an arbitrator may not combine more than one person's claims. You and we give up the right to a jury trial.
- Many similar claims. If 25 or more similar demands are filed by or with the help of the same lawyers or in coordination, they are administered under the AAA's mass arbitration rules.
- Opting out. You can opt out of this section within 30 days of first agreeing to these terms by emailing support@edgecheckout.com with your name and phone number and saying that you opt out of arbitration. Opting out changes nothing else in these terms.
- If part of this section fails. A claim for public injunctive relief is decided in court after any individual claims are arbitrated. If the ban on class actions cannot be enforced for a claim, that claim is decided in court, not in arbitration. The rest of this section stays in force.
15. Privacy
How we handle your details is explained in the Edge Checkout Privacy Notice at edgecheckout.com/privacy.
16. General
If a court finds part of these terms invalid, the rest stays in force. If we do not enforce a term straight away, we can still enforce it later. We may transfer these terms to another company that takes over Edge Checkout for your country; we will tell you first, and the transfer will not reduce your rights. Sections 6, 7 (what we keep and delete), 12, 13 and 14 continue to apply after Edge Checkout ends for you.
